It seems that big brands have their hands full with differing court outcomes…?
A U.S. District Court decided in 2008 that eBay was not liable for any trademark infringement from the sale of counterfeit Tiffany products on its auction site. Tiffany appealed the decision but the U.S. Supreme Court yesterday refused to hear the appeal. Similar cases have also found in favour of eBay (such as the May 2009 L’Oreal v eBay case in France) stating that it is the brand’s responsibility to police counterfeit goods, however others have found in favour of the brands (e.g. Nov 2009, LVMH Moet Hennessy Louis Vuitton v eBay).

SOCA has teamed up with Crimestoppers to promote the Fakes Fund Crime campaign and squash the myth that counterfeiting is a harmless enterprise. British American Tobacco is ready to take the Government to court over proposals to force companies to sell cigarettes in plain packages. The world’s second largest tobacco company said the idea, proposed by health secretary Andrew Lansley, would lead to a sharp rise in counterfeit packs being smuggled into the UK.

Four men have been jailed after counterfeit bank notes worth more than £1m were uncovered by police. Their sentences, handed down at Leeds Crown Court on Wednesday, ranged from 12 years to five-and-a-half years.
